Phoenix Women’s Sports Association
122 N. 2nd Street, Suite A #903 Phoenix, Arizona 85004-2304 Phone: (602) 712-1654 Email: info@phoenixwomenssports.org IV. Scope of This Privacy Policy A. Applies Only to Information Provided/Collected On This Site This Privacy Policy applies only to information provided/collected on this website and not to information you provide through any other means or on any other website. B. Applies Only to the Conduct of PWSA This Privacy Policy applies only to the conduct of PWSA in relation to our website and not the practices of individuals or entities over which PWSA has no control and/or does not employ or manage. For example, you may be required to link to a third party site for secure processing of payments for products/services that may be available for purchase on our site or to make donations. PWSA has no control and does not employ or manage any such third-party payment processor. If you link to a third-party payment processor’s site to enter payment information, you should review the privacy policy of any such third-party payment processor to determine whether you wish to provide personal information on its site. PWSA has no control over any such site’s privacy policy. C. Does Not Apply to Third-Party Websites Any third-party websites you connect to, directly or indirectly, through our site are not under PWSA’ control, or employ or management, and are subject to their own privacy policies, if any, rather than this Privacy Policy. D. Use Of Or Access To This Website Via A Wireless Network Do not to provide personally identifiable information to our website via a wireless network. Even if your machine is running wireless encryption protocols, there is a potential security risk inherent in wireless networks. It is impossible for us to guarantee the security of any such transmissions. E. Notice to International Users Because of the inherent nature of the Internet, our website can be accessed from locations around the world. However, PWSA does not solicit use of our site by visitors outside the United States and our site and servers that make this site available are located in the United States. Access to our site from locations in which the jurisdiction does not give full effect to all provisions of this Privacy Policy is prohibited. IF YOU ACCESS OUR SITE FROM A LOCATION OUTSIDE THE UNITED STATES, YOU DO SO AT YOUR OWN RISK AND YOU ARE SOLELY RESPONSIBLE FOR COMPLIANCE WITH ALL LOCAL AND/OR INTERNATIONAL LAWS. V. Information PWSA May Collect and How It Is Used A. Personally Identifiable Information PWSA is a 501(c)(3) charitable organization. Our website is provided to fulfill PWSA’s mission and for your convenience and information. In order to allow you to take advantage of some of our site’s features, PWSA may need to collect from you “personally identifiable information” (which has been defined to include, for example, a person’s full name, address, email address, telephone number, date of birth, social security number, credit card number, or any other information that, when taken alone or tied to other information, would allow someone to identify or contact you). The type of information PWSA may collect on this website depends upon what you do when you visit our site. For instance, if you wish to receive certain mailings, you may need to provide certain personally identifiable information in order for us to fulfill your request. PWSA does not rent, sell, or market personally identifiable information to any outside third parties without your consent. If we plan to rent, sell, or market your personally identifiable information with an outside third party, you will be notified of this at the time we collect the information, and you will have the opportunity to opt out of such use of your personally identifiable information. Any information you consent to be given to a third party is governed by the rules of that party’s privacy policy, which may differ from this Privacy Policy. You should review the privacy policy of any such third party to determine whether you wish to have PWSA share your information with that party. For instance, as mentioned above, any information provided through our site to a third party payment processor is governed by that third party’s privacy policy. Please be advised, however, that we reserve the right to disclose any personally identifiable information about you without your prior consent if we have a good faith belief that such disclosure is necessary to (1) conform to legal requirements or comply with a valid legal process, such as a search warrant, subpoena, court order, levy, attachment, order of a court-appointed receiver, or other comparable legal process, including subpoenas from private parties in a civil action; (2) protect our rights or property; (3) enforce the provisions of this Privacy Policy; or (4) prevent harm to you or others. It is not necessary for you to provide personally identifiable information to merely visit our site, but access to certain portions of our site may be inaccessible to you. For instance, services such as mailings are not possible without providing certain personally identifiable information on our site. B. Aggregate Information PWSA May Collect Automatically PWSA may collect certain types of aggregate information automatically whenever you access and use our site. However, this information is aggregate in nature and is not by itself personally identifiable. Examples of aggregate information include: (1) the Internet protocol (IP) address of the computer you are using (discussed in more detail below); (2) the date and time you access our site; and (3) the Internet address of the website from which you linked directly to our site. We may use this aggregate information to make sure our website provides you with the resources you need and the level of quality you expect. For example, information about the sections of our site people visit most frequently and least frequently helps us decide which features website users find most useful. PWSA may sometimes share with third parties certain aggregate information. However, this information is not personally identifiable and instead merely consists of aggregate and anonymous facts, such as the average number of visitors to our site per day and the most popular sections of our site. C. Cookies Cookies are alphanumeric identifiers transferred to your computer's hard drive through your Web browser to enable a website to recognize your browser. Cookies enable a website to “remember” information about, for example, your preferences and may allow you to move within a site without reintroducing yourself. We may use cookies to, for instance, track which pages on our site our visitors view and which web browsers our visitors use. Any cookies we may use are used for the purpose of recording information that enables us to provide better service and to customize content. Any information we might collect through cookies is aggregate information. Any cookies we may use do not collect or retain personally identifiable information and we do not combine aggregate information we may collect through cookies with other information such that it would then constitute personally identifiable information. In addition, we do not authorize any third parties to use for their own purposes cookies we may create. Please be advised, however, that sites you link to from our site may use cookies for other purposes. We have no control over and are not responsible for the way other sites use cookies. You should read and understand the privacy policy of any site you link to in order to determine whether and how a particular site uses cookies. < Most browsers are initially set up to accept cookies. You can reset your browser to refuse all cookies or indicate when a cookie is being sent. Please consult the help section of your Web browser to learn how to do this. Please be advised, however, that there may be certain features of our site that will not be available to you and some Web pages that may not display properly if you turn off cookies. D. Web Beacons Web beacons, also known as single-pixel gifs, are images that allow, for instance, a site to collect a cookie number and the time and date a site or page within a site was viewed. Some of our website pages may contain Web beacons. Any Web beacons we may use are used for the purpose of recording certain information that enables us to provide better service and to customize content. Any information we might collect through Web beacons is aggregate information. Any Web beacons we may use do not collect or retain personally identifiable information. In addition, we do not authorize any third parties to use for their own purposes information we may collect through Web beacons. Please be advised, however, that sites you link to from our site may use Web beacons for other purposes. We have no control over and are not responsible for the way other sites use Web beacons. You should read and understand the privacy policy of any site you link to in order to determine whether and how a particular site uses Web beacons. E. Internet Provider (IP) Addresses An IP address is an identifier automatically assigned to your computer when you surf the Web. Web servers automatically identify your computer by its IP address. When you request pages from our site, PWSA servers log your IP address. PWSA may collect IP addresses for purposes of system administration and to report aggregate information (e.g., the number of visitors to certain pages in our site). We do not tie IP addresses to personally identifiable information, which means that your session will be logged but your identity remains anonymous to us. In addition, certain information that is not personally identifiable may be recorded by the standard operation of our servers. This information allows us to keep our site running efficiently. The information we may record includes the browser (e.g., Netscape, Internet Explorer) and the operating system (e.g., Macintosh, Windows) you are using. F. Email If you communicate with us via email, we will share your correspondence with employees, volunteers, representatives, or agents most capable of addressing your correspondence. We will retain your communication until we have done our very best to provide you with a complete and satisfactory response and may subsequently retain your communication for our records. Please be advised that email does not provide a means for completely secure and private communications. Although every attempt will be made to keep your information confidential, from a technical standpoint, there is still a risk and it is impossible for us to guarantee the security of such transmissions. G. User Comments All comments, feedback, postcards, suggestions, ideas, and other submissions disclosed, submitted, or offered to PWSA in connection with your use of this site (collectively “Comments”) shall be and remain the property of PWSA. Unless otherwise prohibited by law, you agree that PWSA may use or disclose Comments in any manner, without restriction and without compensation to you. VI. Managing Your Personally Identifiable Information A. Stopping PWSA’s Use of Your Personally Identifiable Information If you decide you would like to stop receiving information from us, either through the postal service or e-mail, you need only contact us and make such a request (see Contact Information in Section III above). B. Managing Your Personally Identifiable Information We believe it is important for you to be able to find out what personally identifiable information you have provided to us through our site. If you have provided us with personally identifiable information, you can contact us (see Contact Information in Section III above) to request that we provide you with the personally identifiable information we have in our records about you. We reserve the right to limit the number of times such a request can be made and to assess a charge for responding to such requests if this process is misused or abused. We know you want the information we have on record about you to be as complete and accurate as possible. We feel the same way, since maintaining accurate information is essential to our efforts to give you the best possible experience when you visit our site and to provide you with the most up-to-date information about the exciting things happening on our site and with PWSA. Therefore, we encourage you to contact us (see Contact Information in Section III above) to correct any information that might be outdated or otherwise invalid. We will update or correct your personally identifiable information to the extent your request does not compromise this Privacy Policy. If you would like us to delete your personally identifiable information, we will use reasonable efforts to do so upon request. Please understand, however, that it may be impossible to remove the information completely, due to backups and records of deletions. VII. Children’s Privacy (Individuals Under the Age of 13) PWSA is an exempted, non-profit organization under the Children’s Online Privacy Protection Act of 1998 ("COPPA"). However, PWSA is strongly committed to protecting the safety and privacy of children who visit our site. All visitors to our site under the age of 13 are advised not to disclose or provide any personally identifiable information on our site. In the event we discover a child under the age of 13 has provided personally identifiable information to us, in accordance with COPPA, we will stop using the information and, to the extent possible, we will delete the child’s personally identifiable information from our files. VIII. Security Measures PWSA Uses to Protect Personally Identifiable Information When you provide us with personally identifiable information, we know you trust us to use reasonable efforts to keep it safe from unauthorized intrusion. We have in place security control systems designed to prevent unauthorized disclosure of your personally identifiable information. Additionally, only those employees, volunteers, representatives, or agents who need access to your personally identifiable information in order to do their jobs are allowed access, and any employee, volunteer, representative, or agent who violates this Privacy Policy is subject to disciplinary action. HOWEVER, DUE TO THE NATURE OF THE INTERNET AND DEVELOPING TECHNOLOGIES, WE CANNOT PROVIDE ASSURANCES OR GUARANTEES AS TO THE SECURITY OF YOUR INFORMATION, AND PWSA EXPRESSLY DISCLAIMS ANY SUCH OBLIGATIONS. IX. What You Should Do to Protect Your Privacy You have several options when deciding how you can best protect your privacy. One option is simply not to volunteer any personally identifiable information. As stated above, this approach would allow you to still visit our site—although it may prevent you from taking advantage of some of our site's features. The Federal Trade Commission's website, http://www.ftc.gov, also offers useful information about how to protect personally identifiable information provided to a website. X. Online Conduct You agree to use this website only for lawful purposes. Unacceptable uses of this site include without limitation: (i) engaging in any illegal activity or the planning of any illegal activity; (ii) disseminating or transmitting statements, other content, or materials that, to a reasonable person, may be abusive, obscene, pornographic, defamatory, harassing, grossly offensive, vulgar, threatening, or malicious; (iii) creating, disseminating or transmitting files, graphics, software, other content, or material that actually or potentially infringes the copyright, trademark, patent, trade secret, publicity, or other intellectual property rights of any person; (iv) creating a false identity or otherwise attempting to mislead any person as to the identity or origin of any communication; (v) exporting, re-exporting, or permitting the downloading of any message, software, other content, or material in violation of any export or import law, regulation, or restriction of the United States and its agencies or authorities, or without all required approvals, licenses or exemptions; (vi) interfering, disrupting, or attempting to gain unauthorized access to other accounts on our site or any other computer network; (vii) disseminating or transmitting viruses, worms, Trojan horses, time bombs, cancelbots, spyware, or any other malicious or invasive code or program; or (viii) engaging in any other activity deemed by PWSA to be in conflict with the spirit or intent of our website. PWSA reserves the sole and absolute discretion to deny, revoke, or otherwise restrict the access privileges of any user who at any time fails to comply with this Privacy Policy. XI. Ownership of Site Contents; Downloading Unless otherwise noted, all text, images, illustrations, designs, icons, photographs, video clips, and other materials that are part of our site (collectively the "Contents") are copyrighted works, trademarks, trade dress, or other intellectual properties owned, controlled, or licensed by PWSA or used under principles of "fair use." The contents of our site and the site as a whole are intended solely for your personal use. You may download or copy the Contents and other downloadable materials displayed on our site only for such use, provided you do not remove any copyright or other proprietary notices contained on the materials. By allowing you to download these materials, we expressly do NOT transfer to you any right, title, or interest in the materials. XII. Complaints Over Perceived Infringement PWSA respects intellectual property rights, and will terminate registered users and deny access to others who, in our opinion, repeatedly infringe the intellectual property rights of others. In addition, we will use reasonable efforts in light of our resources to accommodate generally accepted technical measures used by copyright owners to identify and protect their copyrighted works. If you believe materials posted on our site infringe rights you enjoy under copyright law in specific materials (collectively a "Work"), we request you contact the designated agent (designated under the Digital Millennium Copyright Act, 17 U.S.C. § 512) identified below to notify us of your concerns or objections.
